Some individuals facing dementia contemplate hastening their own death: weighing the possibility of living longer with dementia against the alternative of dying sooner but avoiding the later stages of cognitive and functional impairment. This weighing resonates with an ethical and legal consensus in the United States that individuals can voluntarily choose to forgo life‐sustaining interventions and also that medical professionals can support these choices even when they will result in an earlier death. For these reasons, whether and how a terminally (...) ill individual can choose to control the timing of their death is a topic that cannot be avoided when considering the dementia trajectory. With a focus on the U.S. context, this landscape review considers the status of provisions that would legally permit people facing dementia to hasten death with appropriate support from medical professionals. This review can be used to plan and guide clinical and legal practitioner discussion and policy development concerning evolving questions not fully covered by existing medical decision‐making provisions. NartonisIn 1846, naturalist Louis Agassiz took Harvard College by storm with his idealist approach to nature. In his initial lectures, repeated in New York the following year, Agassiz announced, "We have that within ourselves which assures us of participation in the Divine Nature and it is a particular characteristic of man to be able to rise in (...) that way above material Nature, and to understand intellectual existences." He then made it clear that by intellectual existences he meant a divine plan of creation. "What naturalists intend when they speak of what they call 'types'... may be easily understood by comparison. We all know that architects construct our dwellings according to plans conceived by them before the erection of the edifice."1 There is no doubt that Agassiz valued the careful collection of observational data. "It has only been step by step that man has acquired an insight into this plan."2 But his empiricism, if that is the right term, was entirely subordinate to apprehension of divine ideas, which alone deserved to be called science. In one recent account, The Metaphysical Club, which contains an excellent discussion of Agassiz's American career, author Louis Menand accurately describes this dual emphasis on observation and intuition. But Menand leaves unstated the problem of [End Page 437] Agassiz's welcome at Harvard, attributing his instant popularity to force of character.3A fuller explanation of Agassiz's welcome is to be found in the Scottish textbooks that dominated the Harvard philosophy curriculum prior to his arrival.4 Like Agassiz, textbook authors Thomas Reid, Dugald Stewart, and Thomas Brown recognized observation and intuition as twin sources of human knowledge. According to them, we observe our own moral tendencies and interpret them in the light of intuited ethical principles that even God must obey. Similarly, we observe nature and interpret its workings with the aid of intuited principles of common sense.5 There is no doubt that this dual emphasis on observation and intuition was entirely consistent with Agassiz's idealist biology. But his definition of species and genera as intellectual existences in the divine mind was not to be found in the official Scottish texts. In fact, Dugald Stewart, who governed the philosophy curriculum after 1820, insisted that there are "no existences in nature corresponding to general terms, and the objects of our attention in all our general speculations are not ideas but words."6 This was "long misunderstood by philosophers, who imagined that a generic word expresses an actual existence distinct from the individuals of which the genus is composed."7 Similarly, Thomas Brown lamented, "One fundamental error... as long as it retained its hold of the understanding, must have rendered all its energies ineffectual, by wasting them in search of objects, which had no real existence... I allude to... the various orders of universals."8 In this one respect, Stewart and Brown were in agreement with Alexander Pope when he counseled his many American readers "presume not God to scan" and ridiculed those who would "soar with Plato to th' empyreal sphere."9But Harvard students and faculty were also reading books that promoted the intellectual existences that Agassiz saw behind nature and the Scots did [End Page 438] not. Chief among these books were Plato's Works (ca. 360 BCE), Philo's De Opificio Mundi (20 BCE to 50 CE), Ralph Cudworth's The True Intellectual System of the World (1678), and John Norris's An Essay towards the Theory of the Ideal or Intellectual World (1701–04). These combined with such widely popular literature as John Milton's Paradise Lost (1668) and the prose works of Samuel Coleridge to form a kind of unofficial curriculum that ultimately made Agassiz's idealist view of nature especially welcome at Harvard.10 Modest at first, Harvard interest in intellectual existences bloomed with the appearance of books by Romantic writers on campus. An analysis is made of Pope Francis’ Encyclical Laudato Si from a general systems approach. A call is made for a dialogue between theologians and environmental scientist. A parallel is found between the Pope’s identification of rapidification as a root cause of global warming and McLuhan’s notion of the speedup of modern life due to the emergence of electric technology. An analysis of Hebrew Scriptures is made, suggesting that rather than subduing the earth, the translation of Gen 1:28 (...) seems to indicate that the intention was to occupy and tend the land. The Jewish notion of Bal Tashchit one of the 613 mitzvos or commandments from Scripture, supports this interpretation as it calls for stewardship of G-d’s gifts. (shrink)

The text is the extended version of the lecture delivered at the occasion of the author’s farewell as Professor of Moral Theology at Tilburg Faculty of Theology. The tradition of canon law, dogmatics, and moral theology is familiar with the concept of “ius divinum”, divine right. This concept indicates that certain standards, orders and institutions can be seen as if having been set up by God himself. For example: the primacy of the Pope, the seven Sacraments, or, in moral (...) theology, the standards of natural law. Because they do not encompass human institutions, man cannot abolish them. However, what does it mean in our present times to contend that God himself has instituted certain standards and institutions in our world, and that they are therefore beyond human authority? In this contribution the thesis is defended that the so-called divine right does not have to be considered a taboo but rather that it is thoroughly human. This in the dual significance of human: it is of human origin and it serves mankind, it is for the good of humanity. On the one hand, “divine right” is not only a phenomenon within the human world, but, more radically, a phenomenon from this human world, made by human beings themselves. On the other hand, such an anthropocentric vision does not indicate the end of a meaningful reference to God and of the understanding of human life in the countenance of God. To the contrary, the divine within a divine right finds its criterion in its very humanity, its humane kindness. With a short reference to the ethics of human rights, which tries to interweave the unconditional moral obligation and modern anthropocentrism, the search for traces of divine right in this world is brought to completion. Western society is steadily inundated by technology. Pope Benedict XVI has presented a positive but cautious analysis of biotechnological development. Within the context of man’s yearning for love and truth, Benedict explicates a vision of authentic human progress that recognizes that the telos of technical progress in biomedicine is the good of the human person. He criticizes the “consensus model” of bioethics, which is prevalent in our cultural technopoly, because it leaves science unfettered and emphasizes arbitrary consensus at the (...) cost of an ethical evaluation, which honors the dignity of the person and the rights of man. Benedict XVI proposes a bioethical model which is open to God, is consistent with natural law, and views the human person as its telos. The lack of consensus in American society regarding the permissibility of assisted suicide and euthanasia is due in large part to a failure to address the nature of the human person involved in the ethical act itself. For Karol Wojtyla, philosopher and Pope, ethical action finds meaning only in an authentic understanding of the person; but it is through acting ( actus humanus ) alone that the human person reveals himself. Knowing what the person ought to be cannot be (...) divorced from what he ought to do; forWojtyla, the structure of the ethical “do” – the act itself – comes first. The current paper will focus on four arguments used to justify assisted suicide and euthanasia: (1) the argument from autonomy, (2) the argument from compassion, (3) the argument from the evil of suffering, and (4) the argument from the loss of dignity. It will seek to answer each claim from the perspective of Karol Wojtyla's philosophical anthropology. Much of this will come from his defining work in pure philosophy, The Acting Person (1969). The final part of the paper will suggest some positive solutions to the stalemate over the euthanasia debate, again drawn from Wojtyla's idea of human fulfillment through participation with the other, and with the community itself. Caritas in veritate (Charity in Truth) is the ''social'' encyclical of Pope Benedict XVI, one of many papal encyclicals over the last 120 years that address economic life. This volume, based on discussions at a symposium co-sponsored by the Institute for Advanced Catholic Studies and the Pontifical Council for Justice and Peace, analyzes the situation of the Church and the theological basis for Benedict's thinking about the person, community, and the globalized economy.

Our tendency is not to read Romantic poetry as alluding to the texts it reminds us of. We think of the Augustans as the author of what Reuben Brower calls "the poetry of allusion."5 We envision Romantic poets carrying on their work in reaction to these Augustans and in mysterious awe, whether fearful or admiring, of most other poets—sometimes even of each other. No self-respecting Romantic, it is usually assumed, will deliberately send his reader elsewhere for a meaning to complement (...) the effect of his own words. If a reader's mind wanders to an earlier poem, that is not the Romantic poet's fault but a matter of accident or perhaps of cruel destiny. The Romantic wants to keep the poem an intimate affair—just the two of us—and does what he can to keep his reader's attention on himself.[…]What follows is an effort to test the applicability of Wasserman's Augustan hypothesis to the poetic mode of high Romanticism. This effort should not be taken to imply either that the Romantics simply continue in the allusive mode of the Augustans or that the assumptions that lead Bloom and others to read Romantic poetry as they do are utterly mistaken. I will in fact be arguing quite otherwise. Nor must there be any confusion about Wasserman's conception of the Augustan mode. Some of the language of his summary, for example where he speaks of "the rich interplay between the author's text and the full contexts it allusively arouses," might lead one to liken his work to the criticism now associated with the notion of "intertextuality." For the practitioners of this criticism, as Jonathan Culler explains, "to read is to place a work in a discursive space, relating it to other texts and to other codes of that space, and writing is a similar activity."8 Writing and reading a poem are in this account both acts of "intertextual location," if you will, but the reader of the poem need not concern himself with the aims and circumstances of its writer's "similar activity." The decisive difference between this view and the one Wasserman offers for the Augustans is that Wasserman's is intentionalist and historicist. This shows plainly in his exegetical commentary on the Rape, where his characteristic claim follows the formula: "Pope [expects, invites, prods, wants] his reader to [discover, exercise his wit on, recognize, see] X in his allusion to such-and-such a text." And to support his claim he repeatedly brings his historicist scholarship to bear on questions about "the kind of ready knowledge Pope demands of his reader" and what "facts [were] known to any serious reader" of the time.95. Karol Wojtyła—the future pope John Paul II—chose the human being, especially in its personalistic dimension, as the main point of his philosophical research. Inaccordance with the metaphysical rule agere sequitur esse, he investigated the dynamisms proper to a human being: the reactive dynamism of the human body, the emotive dynamism of the human psyche, and the personalistic dynamism associated with free choice of the will. These allowed him to experience and understand the human being as a complex yet integrated (...) entity. The personal structure of the human being is manifest in terms of selfpossession, self-determination, and self-governance. Thanks to self-possession, human beings experience freedom of the will, which expresses itself in each free act. Being endowed with a free will, the human being is able to grow in freedom but can also lose his freedom. Wojtyła’s philosophical investigations are innovative by way of the use that he made of the philosophy of being according to Thomas Aquinas and the philosophy of consciousness articulated by Husserl. He not only pointed out man’s structure but also presented man as an objective entity in an objective world. Each human being is constituted by his or her inner self, which is absolutely exceptional because it is completely irreducible to anything else in the world. (shrink)

The underlying problem addressed by Pope Benedict XVI’s first encyclical is how the modern state usurped and perverted the Church’s charitable enterprises. The Church invented public schools, hospitals, and family services and ran them for a millennium as the “better half” of Christendom’s aristocratic, oligarchic, and democratic regimes. Beginning in the sixteenth century, however, and culminating in today’s social justice movement, the Church’s institutions of discerning love have been supplanted by political agencies, operating on the basis of universal and (...) homogenous justice. This robbed the Church of its visible moral authority, metastasized the political administration, and corrupted both the charity and its recipients. This paper explores one aspect of the political in the early Hegel, that of criminal action and its relationship to the concept of recognition in the System of Ethical Life. While it is clear that in this work Hegel thinks that criminal action plays an important role in the transformation of simple ethical communities, it is not clear that, for Hegel, the formal character of crime in the struggle for recognition is anything but negative. I attempt to show how this (...) role for crime leads Hegel to a legalistic conception of Right that has no solid connection with recognition as a social force. (shrink)

The Socio-Cultural pluralism and its fabrics in our society have been under the threat of religious fundamentalism and ideological extremism, which firmly believe that there can only one way of true expression and all other forms, are either substandard or false. This attitude has torn away the world into different isolated islands of human settlements. This state of affair is the outcome of multidimensional causes and one among them, no doubt, is related to one of the central issues of Philosophy, (...) i.e., the relation between ‘one and many’. The ontological dimension of the problem of ‘one and many’ cannot be solved withouthaving the proper understanding of epistemological solutions. The epistemic tools of the Advaita Vedanta are powerful enough to suggest pragmatic solutions to the good old problem of ‘one and many’ that attains new relevance in the era of Globalization. The logic of identity in difference and the logic of difference are the two types of logical systems, which are instrumental for the formulation of various types of claims to know of the western tradition. The logic of identity in difference has been clearly designed and defined by the classical logic or the Aristotelian logic. The symbolic logic encarves the various nuances of the logic of difference. The Advaita System has envisaged a new logic i.e., the logic of identity, which is implicit in the Upanisdic mahavakyya ‘Ayam Āthmam Brahma’. Increasingly, national governments across the globe are prioritizing investments in neuroscience. Currently, seven active or in-development national-level brain research initiatives exist, spanning four continents. Engaging with the underlying values and ethical concerns that drive brain research across cultural and continental divides is critical to future research. Culture influences what kinds of science are supported and where science can be conducted through ethical frameworks and evaluations of risk. Neuroscientists and philosophers alike have found themselves together encountering perennial questions; these questions are (...) engaged by the field of neuroethics, related to the nature of understanding the self and identity, the existence and meaning of free will, defining the role of reason in human behavior, and more. With this Perspective article, we aim to prioritize and advance to the foreground a list of neuroethics questions for neuroscientists operating in the context of these international brain initiatives. The unknown nature of tomorrow’s research makes informed consent in biobank research a challenge. Whether the consent given by biobank participants is ‘broad’ or ‘narrow’, the ever present question remains the same: are new activities covered by the original consent? In this article, we focus on the meaning of, and the relation between, broad consent and re-consent in biobank research. We argue that broad consent should be understood as consenting to a framework—a framework which covers aims, core conditions for acceptable (...) use, governance and how these affect participants. Changes that alter the framework in a fundamental way call for re-consent. Three biobank cases of current international interest are used to debate when re-consent is an ethical necessity: whole-genome sequencing, data sharing and commercial utilization. These reflections give us a more nuanced view on what consent is for. We claim that the introduction of broad consents in biobank research has not represented a betrayal of individual participant interests, as some critics have asserted. Broad consents combined with the possible use of re-consent are in certain settings not inferior, but rather ethically superior to narrow consents. In population-based research biobanks, they allow for a reconciliation between individual interest and public matters in society at large. (shrink)
